Report - Sentencing in relation to offences captured by section 40 of the Domestic Violence Act 2018

The content of this document was prepared by the Sentencing Guidelines and Information Committee of the Judicial Council after extensive research and consultation. It was submitted to the Board on the 4th of April 2025 in the form of a draft Sentencing Guideline, in accordance with s.23 of the Judicial Council Act 2019. The Board reviewed and approved the draft, without modification, on the 12th of May 2025. The Board cannot, however, put the draft before the Judicial Council for adoption having regard to the decision in Delaney v. Personal Injuries Board [2024] IESC 10. In those circumstances, pending the enactment of any required amending legislation, the Board has decided to approve the circulation and publication of this document by way of information and assistance for sentencing judges. It is titled a “report” to emphasise that it does not have any legal effect.
